Petitioner seeks bail in Mehandia P.S. Case No.31 of 2019 instituted for the offence under Section(s) 341, 323, 307, 386, 504/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner is not named in the First Information Report. Nothing incriminating has been recovered from his possession. In the written report, it is alleged that informant was going on Scorpio vehicle. In the way at about 7.00 PM when he reached near Lodipur Musepur bridge, there was a road jam. The informant got down from the vehicle and saw Rohit Kumar, Ankit Sharma, Kariman along with 2-3 unknown were collecting money from the truck loaded with sand. The

Patna High Court CR. MISC. No.45689 of 2019(2) dt.29-07-2019 2/2 informant raised protest upon which Rohit Kumar fired at informant causing injury in his left side of neck. Thereafter, they fled away.

The police during investigation recorded statement of Sanjay Kumar, Sudhir Kumar and Mahesh Kumar, who have disclosed name of the petitioner.

Petitioner is in custody since 21.04.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal, in connection with Mehandia P.S. Case No.31 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
