2. The petitioner seeks regular bail in the present case registered for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
3. There is recovery of 134.28 liters of illicit liquor and the petitioner is in jail since15.06.2024
4. Learned counsel for the petitioner submits that the petitioner is ready to donate Rs. 10,000/- (Rupees Ten Thousand Only) in some charitable organization without accepting his guilt.
5. Considering the facts and circumstances of the case and the submission of learned counsel for the petitioner, let the
Patna High Court CR. MISC. No.51439 of 2024(3) dt.06-12-2024 2/2 petitioner, above named, be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-1, Samastipur/concerned Court below in connection with Bibhutipur P.S. Case No. 200 of 2020 subject to the conditions that:- (i). The petitioner shall deposit an amount of Rs. 10,000/- (Rupees Ten Thousand Only) in Ramakrishna Mission Sevashrama, Bela, Muzaffarpur and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted only after verifying the genuineness of the receipt produced by the petitioner.
(ii). The petitioner is directed to mark his attendance at Khnpura Police Station on every Sunday of every month. Failure to do so, will result in cancellation of bail bond of the petitioner.
