JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-324, 506, 385, 307 & 379 of the Indian Penal Code. Earlier Cr. Misc. No. 14794 of 2016 was filed by the petitioner but the said Cr. Misc. case was dismissed because the petitioner could not give the details of his criminal antecedent and now, he has filed this second bail petition.
There is allegation against the petitioner that he gave one sword blow, causing injury to the informant on his head. The informant sustained altogether four injuries but the injuries, sustained by the informant, are said to be simple in nature. Learned counsel for the petitioner submits that there
Patna High Court Cr.Misc. No.22683 of 2016 (3) dt.17-08-2016 2/2 is long standing enmity between the parties and the informant as well as his henchmen are in habit of filing cases against the petitioner and his other family members.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bahera P.S. Case No. 326 of 2014 to the satisfaction of learned Sub Divisional Judicial Magistrate, Benipur, Darbhanga.
