Petitioner, already in custody, seeks bail in connection with Chanpatia (Sirisia) P.S. Case No.229 of 2016, giving rise to Sessions Trial No.332 of 2017, registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the FIR is against unknown, neither any incriminating material was recovered from possession of the petitioner nor he was put on TIP and the petitioner is in custody in this case since 25.02.2017.

Having considered the said facts and circumstances, petitioner Faiyaz Ansari is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two

No.11335 of 2018(2) dt.28-02-2018 2/2 sureties of the like amount each to the satisfaction of learned 5th Additional Sessions Judge, West Champaran, Bettiah in connection with Chanpatia (Sirisia) P.S. Case No.229 of 2016 with condition that the petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
