JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Pakrideyal P. S. Case No.44 of 2016 registered under Sections 302 and 120-B/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that though the petitioner is named in the FIR, there is no allegation made against her. The specific allegation in the first information report is against Arun Bhagat and Dilip Kumar and some others. However, at the bottom of the written report, the name of the petitioner and three other ladies has been given and a request is made to the officer-in-charge of the police to take

Patna High Court Cr.Misc. No.1174 of 2018 (2) dt.19-01-2018 2/2 appropriate action against them.

Learned Additional Public Prosecutor for the State opposed the prayer for grant of pre-arrest bail to the petitioner. However, after going through the FIR, he could not point out any material against the petitioner in the written report. Regard being had to the contends of the FIR and the submissions made above, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Motihari, East Champaran in Pakrideyal P. S. Case No. 44 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
