JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-08-2022 Though the present writ petition has been filed for directing the respondents to remove the encroachment made over the public road appertaining to Plot No. 736, 737, 738, 739 and 740 situated at village-Kandi, P.S. Tandawa, AnchalNabinagar, District-Aurangabad, however, the learned counsel for the petitioner has limited his prayer to grant of liberty to the petitioner to approach the Circle Officer, Nabinagar, District-

Patna High Court CWJC No.3391 of 2021(2) dt.26-08-2022 2/2 Aurangabad i.e. the respondent no. 4. Liberty so sought is granted.

It is needless to state that in case appropriate petition is filed under the provisions of the Bihar Public Land Encroachment Act, 1956 before the respondent no. 4 within a period of four weeks' from today, the respondent no. 4 shall consider the same and pass appropriate orders thereon, in accordance with law after hearing the affected parties, within a period of 12 weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
