JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but no specific overt-act has been attributed against him. The contention on behalf of the petitioner is that the petitioner had filed complaint case against the officer in charge of Imamganj Police Station and that is the reason he has been implicated in the present case as well as several other cases. It is also pointed out on behalf of the petitioner that one co-accused Bhutali Ji @ Dhanik Lal Mandal having similar allegation has already been granted privilege of bail by a co-ordinate Bench of this Court. It is also pointed out on behalf of the petitioner that the aforesaid co-accused, Bhutali Ji @ Dhanik Lal Mandal had

Considering the aforesaid facts and circumstances as well as submissions of the parties and with a view to maintain the parity of justice, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Abhay Srivastava, Judicial Magistrate 1st Class, Sherghati, Gaya in connection with Imamganj P.S. Case No. 110 of 2012.
However, it is made clear that the conditions imposed upon the co-accused, Bhutali Ji @ Dhanik Lal Mandal vide order dated 12.01.2015 passed in Cr. Misc. No. 930 of 2015 shall also apply to the petitioner.
