2. In the present case, the petitioner seeks bail in connection with Lodipur P.S. Case No. 184 of 2024 registered for the offences under Sections 103(1), 351(2), 352 and 3(5) of the BNS.
3. As per prosecution case, the petitioner shot dead his elder brother.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. From the FIR, it is clear that no one has seen the occurrence. Petitioner and his entire family members have been falsely implicated due to land dispute. There is no eye-witness to the occurrence and the informant has

No.47216 of 2025(3) dt.16-09-2025 2/3 motive to falsely implicate the petitioner as the brothers have been selling their ancestral land to different persons and due to this land dispute and in order to grab the share of the petitioner, the petitioner and his family members were made accused in the present case. Learned counsel further submits that even in CCTV footage, it has been mentioned that a person wearing helmet came on a bullet motorcycle and left on the same motorcycle wearing the helmet and from his gait it was inferred that he was the petitioner of this case. Petitioner is in custody since 14.12.2024 and charge-sheet has been submitted. Petitioner is having antecedent of two cases and he is on bail in both the cases.
5. Learned A.P.P. as well as learned counsel appearing on behalf of the informant vehemently oppose the submission made on behalf of the petitioner. Learned counsel for the informant submits that due to land dispute the petitioner killed his elder brother and witnesses examined during investigation have supported the prosecution. The informant, his son and the teacher who has been giving tuition to his son have also stated about the petitioner killing his elder brother.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the
Patna High Court CR. MISC. No.47216 of 2025(3) dt.16-09-2025 3/3 serious nature of allegation against the petitioner for killing his elder brother, I am not inclined to enlarge the petitioner on bail, hence, his prayer for bail is rejected.
7. The learned trial court is directed to expedite the trial and conclude the same at the earliest.
