The petitioners are languishing in custody since 14.09.2015 and 19.08.2015 respectively in connection with Islampur P.S. Case No. 187 of 2015 for the offences instituted under Sections 302/34 of the IPC.
The accusation is of killing the father of the informant by the accused persons.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners are in custody since 14.09.2015 and 19.08.2015 respectively and the charge sheet has been submitted in the present case. There is no
Patna High Court Cr.Misc. No.21170 of 2016 (3) dt.22-07-2016 2/2 allegation of tampering with the evidence against the petitioners. No specific injury has been attributed against the petitioners. General and omnibus allegation has been made against the petitioners. The allegation is of assaulting the deceased with fists and slaps. Postmortem report reveals the cause of death is due to injury caused by hard and blunt substance. The postmortem do not support the allegations made in the F.I.R.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Hilsa, Nalanda, in connection with Islampur P.S. Case No. 187 of 2015.
