1. Heard the parties.

2. Petitioner seeks regular bail in connection with Suryapura P.S. Case No. 68 of 2024 dated 19.03.2024 registered for the offence(s) punishable under Section(s) 20(b)ii(b) and 22(b) of the N.D.P.S. Act.

3. Mr. Jai Prakash Singh, learned counsel for the petitioner submits that as per prosecution's story, four persons, including the petitioner were apprehended with the alleged narcotic material namely, Ganja and petitioner is said to have been found with four Kgs of seized Ganja and the same falls in the intermediate quantity and against him, investigation has been completed. Though, against the petitioner there is criminal antecedent of one case but the same does not relate to the offence under the N.D.P.S. Act and he is on bail in the said

Patna High Court CR. MISC. No.53088 of 2024(2) dt.06-08-2024 2/2 antecedent case and the petitioner has been languishing in jail since 20.03.2024.

4. Mr. Nawal Kishore Prasad, learned APP appearing for the State opposes the bail prayer.

5. Considering the above submissions and mainly taking into account the petitioner's custody period and completion of investigation against him coupled with the quantity of alleged contraband which is said to have been recovered from the possession of the petitioner, this court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail in connection with Suryapura P.S. Case No. 68 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
