The petitioner wants to renew his prayer of bail, which was earlier rejected twice vide order dated 15.12.2016 and 16.08.2017 passed in Cr. Misc. Nos. 47333 of 2016 and 33013 of 2017 respectively, on the ground that the petitioner is in custody since 08.09.2016 and there is no progress in the case as charges have been framed on 05.01.2018 and as such in near future the trial is not likely to be concluded. Learned APP opposes the prayer of bail by submitting that against the petitioner there is specific allegation for opening the fire which hit in the back of the deceased.
In the facts and circumstances stated above, finding no good ground for reconsideration of the prayer of bail of the
Patna High Court Cr.Misc. No.6312 of 2018(2) dt.21-02-2018 2/2 petitioner, again his such prayer stands rejected. However, learned trial court is again directed to expedite the trial and conclude the same as early as possible, preferably within four months from the date of receipt/production of a copy of this order, failing which, the petitioner, if at no fault, may be at liberty to renew his prayer of bail.
