JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 This is an application for grant of anticipatory bail in connection with Aurangabad Town P. S. Case No. 103 of 2019 disclosing offence under Section 304 of the Indian Penal Code. As per F.I.R. husband of the informant was going with the petitioner for realization of the amount, thereafter, she received a phone calls that her husband was unconscious. On that, she came to the hospital and came to know that her husband was dead, who was brought by two female members and they fled away and on CCTV footage, they have identified, as such, the present case has been lodged.

Submission of the learned counsel for the petitioner is that in good faith, she has brought the deceased to the hospital and except that there is no direct allegation against her only on suspicion, she has been made accused in this case.

Patna High Court CR. MISC. No.46585 of 2019(5) dt.08-01-2020 2/2 Heard learned A.P.P. also who has opposed the prayer for anticipatory bail on the ground that the deceased had gone to realize the money to the house of the petitioner and she has brought her husband to the hospital, as such, there is strong suspicion against the petitioner.

Having heard both sides and perused the viscera report that disclosed no Metallic, Alkaloidal, Glycosidal, Pesticidal or Volatile Poison could be detected in the viscera. Considering the above, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Town P. S. Case No. 103 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition to co-operate in the investigation and appear as and when required.
