The petitioner seeks bail in a case under Section 302/34 of the Indian Penal Code and under section 27 of the Arms Act.

The informant alleged that his brother, Md. Ibrar, was called and thereafter he was shot dead. The name of the petitioner and other accused persons figured in the case on the basis of disclosure made by Kaisar.

It is submitted that co-accused Jai @ Jai Kumar @ Aswani Kumar Mishra @ Aswani, Dilip Kumar Mahto, Noor Alam, Babloo @ Md. Asrar Alam have already been enlarged on bail and Noor Alam was put on T. I. parade but Kaisar did not

Patna High Court Cr.Misc. No.30412 of 2015 (2) dt.13-08-2015 2/2 identify him although he is said to have disclosed the name of Noor Alam and other accused persons and the case of petitioner stands on same footing.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in Sadar P.S. Case No. 132/2014.
