JUSTICE SANJAY KUMAR ORAL ORDER 28-02-2018 Heard learned counsel for the petitioner and learned counsel for the informant.

Petitioner apprehends arrest in connection with Darauli P.S. Case No.180 of 2017 registered for the offences under Sections 353, 307, 504 and 506 of the Indian Penal Code. The informant of this case is a Junior Electrical Engineer. It is alleged that on 22.08.2017 when he visited at the place of this petitioner for disconnection of electricity of the defaulters, this petitioner raised protest and asked the informant to make necessary corrections in his electricity bill. In the meanwhile the petitioner started abusing the informant and

Patna High Court Cr.Misc. No.7795 of 2018 (3) dt.28-02-2018 chased the informant with intention to kill him. It has been submitted that no offence under Sections 353 or 307 of the Indian Penal Code is made out. The informant has maliciously lodged the case against the petitioner. The petitioner has clean antecedent.

The learned counsel for the informant opposed the submission.

Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioner in the event of arrest or surrender before the learned court below within six weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten thousand) with two sureties of the likewise amount each to the satisfaction of learned A.C.J.M.-III, Siwan in connection with Darauli P.S. Case No.180 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
