2. Both these criminal miscellaneous applications have been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS,
Patna High Court CR. MISC. No.47751 of 2026(2) dt.22-07-2026 2/3 2023') for grant of anticipatory bail to the petitioners who apprehend arrest in connection with Karja P.S. Case No. 337 of 2025, lodged on 02.12.2025, under Sections 126(2) /115(2) / 118(2)/109/76/303(2)/3(5) of B.N.S. Act, pending in the Court of learned Judicial Magistrate, 1st Class, Muzaffarpur.

As per the prosecution, the FIR has been lodged against ten accused persons including the present petitioners with allegation that while the informant, his father and his wife were at their filed the accused persons came with iron rod, sticks, bricks etc. abused and assaulted. They threatened to kill if anyone tried to intervene. Specific allegation of assault by iron rod and sticks on the head of his father is against the petitioners. Allegation of taking gold chain is also there.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He submits that criminal antecedent of the petitioners is clean. He submits that before this case the father of the petitioner had lodged an FIR against the family members of the informant bearing Karja P.S. Case No.191 of 2020. He submits that the petitioners are ready to fulfill all the conditions whatsoever shall be imposed upon them.
5. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.47751 of 2026(2) dt.22-07-2026 3/3 bail of the petitioners and submits that there are specific allegation of assault against the petitioners on the head of the informant's father.
6. Considering the direct allegation of assault against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners. Hence, anticipatory bail applications of the petitioners are hereby rejected. However, in the event of surrender of the petitioners within six weeks from today, the prayer for regular bail shall be considered on the same day without being prejudiced by the order of this Court.
