The petitioner is in custody since 20.02.2016 in connection with Bahadurganj P.S. Case No. 21 of 2016 registered for an offence under Sections 419, 420, 467, 468, 504 and 506/34 of the Indian Penal Code.

The prosecution case is that in the examination of T.E.T. the petitioner assured some candidates to pass out by adding grace number and for that he collected cash and when the T.E.T. card got verified, the same was found fake. The informant and some other complained for correction, but, neither the money has been returned nor the genuine result card has been given rather the candidates have been threatened to be implicated in false case. It is submitted that the petitioner is a Government School Teacher posted at Kishanganj. He has been made accused in the present case due to mistake of fact. The allegation made in the first information report is denied by the petitioner. It is, further, submitted that the petitioner is ready to deposit an amount of Rs.50,000/- within a period of two months in Court below,

Patna High Court Cr.Misc. No.22845 of 2016 (3) dt.17-08-2016 which shall be subject to the final disposal of the case. Learned counsel for the petitioner submits that the petitioner is in custody since 20.02.2016. Charge sheet has been submitted in the case. There is no criminal antecedent against the petitioner. There is no allegation of tampering of witnesses alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs.50,000/- in the Court below within a period of two months, which shall be subject to the final disposal of the case. The petitioner be released on provisional bail for two months on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bahadurganj P.S. Case No. 21 of 2016 to the satisfaction of the Chief Judicial Magistrate, Kishanganj.

If the petitioner deposits the said amount, the provisional bail, granted to him, shall be confirmed by the Court below, itself.
