Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Amarpur Fulidumar P.S. Case No. 276 of 2014 instituted for the offences under Sections 147, 148, 149, 435, 437 of the Indian Penal Code, Section 27 of the Arms Act, Sections 3 and 4 of the Explosive Substance Act and Section 17 of the CLA Act. Learned counsel for the petitioner submits that the petitioner is in custody since 08.07.2021, charge-sheet has been submitted and has antecedent of one case.
The allegation in the FIR is that some miscreants set the Vode Phone Tower on fire.
Learned counsel for the petitioner submits that the

No.58953 of 2021(2) dt.08-03-2022 2/2 petitioner is not named in the FIR and his name transpired in the confessional statement of co-accused Ashok Tanti who has been granted bail by a coordinate Bench of this Court vide order dated 17.05.2016 passed in Cr. Misc. No. 14948 of 2016 and another co-accused Manthan Singh @ Suraj Singh has also been granted bail by a Coordinate Bench of this Court vide order dated 03.03.2020 passed in Cr. Misc. No. 4156 of 2020. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted and co-accused have been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur Fulidumar P.S. Case No. 276 of 2014.
