The husband of the deceased is facing accusation punishable under section 304-B vide Deoria P.S. Case No. 59 of 2010 and seeks regular bail. Within seven years of marriage the deceased was done to death in the matrimonial home under mysterious circumstances inasmuch as no post mortem was allowed to be conducted on the dead body. The dead body was disposed of. It is a case of dowry death.
It is submitted that the petitioner is languishing in jail since 28.11.2014. There is no eye witness to the occurrence. Considering the allegations and materials reflected from the record, I am not inclined to enlarge the petitioner on bail. His
Patna High Court Cr.Misc. No.15150 of 2015 (3) dt.23-06-2015 2 / 2 prayer is rejected. In case the trial does not record adequate progress within one year from the date of receipt/production of a copy of this order the petitioner shall have liberty to renew his prayer for bail in the court below itself.
