JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 147, 148, 149, 302, 326, 120(B) of the Indian Penal Code and 27 of the Arms Act. The petitioner is named in the First information Report but only allegation of instigation has been levelled against him and co-accused Satyanarayan Singh and so far as assailant is concerned, it is alleged that it was co-accused Rahul Yadav, who happens to be the son of the petitioner, shot fire on the deceased. Submission on behalf of the petitioner is that the petitioner is Sub-Inspector of Police and had come to his home on

Patna High Court Cr.Misc. No.20861 of 2016 (2) dt.19-05-2016 leave but due to village politics, he has been implicated in this case and moreover, the petitioner does not have any criminal antecedent. The petitioner is languishing in jail custody since 27.02.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Town P.S. Buxar P.S. Case No. 74 of 2016.
