The petitioner seeks regular bail in connection with Bodh Gaya P.S. Case No. 105 of 2019 for the offences punishable under Sections 25(1-b)/A/26 of the Arms Act and 37(2) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding the police having apprehended the petitioner and upon search, 3 country made pistols along with some live cartridges were recovered and the petitioner is found to be in an inebriated condition and smell of liquor was oozing out from his mouth.

The learned counsel for the petitioner submits that the petitioner been falsely implicated in the present case and though he is accused in one case but he is on bail in the said case.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Bodh Gaya P.S. Case No. 105 of 2019.
