JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Kotwali P.S. Case No. 16 of 2016, registered under Sections 414 of the Indian Penal Code and 25(1-b)a, 26/35 of Arms Act. The accusation is that petitioner along with others were apprehended by the Police and on search, petitioner was found in possession of one loaded pistol with two live cartridges. Learned counsel for the petitioner submits that petitioner is accused in two other cases as detailed in para 3 of the petition, but he is on bail in both cases. The petitioner is in custody since 08.01.2016.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.20660 of 2016 (2) dt.13-05-2016 2/2 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 16 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
