Petitioner seeks bail in a case registered under section 394 of the Indian Penal Code as well as section 27 of the Arms Act. Petitioner is not named in the first information report but in course of investigation at para 11 of the case diary, one witness, namely, Ram Umesh Yadav claimed that one Laxman Sahni used to come at Petrol pump to meet Purshottam Kumar and enquired about the sale of petrol pump. One day, petitioner also accompanied the aforesaid Laxman Sahni. After disclosure of the aforesaid fact, some co- accused were arrested and confessed their guilt disclosing the names of accused persons including the petitioner. Moreover, co- accused Laxman Sahni and Rahul Raj, having similar allegation, have already been granted privilege of bail by
Patna High Court Cr.Misc. No.20988 of 2016 (2) dt.20-05-2016 different benches of this court.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Dumra P.S. Case no. 314/2015.
