ANJANA MISHRA ORAL ORDER 05-03-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody on his remand since 04.01.2018 in connection with Sessions Trial No.221/17/39/17, arising out of Madanpur P.S. Case No.77 of 2014, registered for the offence under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., but only on the basis of his self-confessional statement made in connection with Muffasil P.S. Case No. 41 of 2016, that the petitioner has been remanded in connection with the present case. Learned counsel further submits that there are many cases against him

Patna High Court Cr.Misc. No.8253 of 2018 (3) dt.05-03-2018 2/2 and in most of the cases, he has been remanded on the basis of the confessional statement made before the police, which has no evidentiary value. He further submits that similar is the situation in the present case. It is further submitted that till date, no T.I. Parade has been conducted so as to implicate the petitioner.

Having considered the entire facts and circumstances of the case and the materials which have come on the record, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 7th, Aurangabad (Bihar), in connection with Sessions Trial No.221/17/39/17, arising out of Madanpur P.S.
