This is an application for grant of anticipatory bail in connection with Kako P.S. Case No. 210 of 2017 registered for the offence punishable under Sections 147, 149, 341, 504, 506, 323, 325, 307 and 379 of the Indian Penal Code. The allegation is regarding altercation having taken place in between the prosecution side and the informant side on account of cutting of grass field of wife of one Ajay Yadav, cousin brother of the petitioner herein. It appears that thereafter a counter case has also been filed by the petitioners side.

The learned counsel for the petitioner submits that the present case arises out of case and counter case and both sides

Patna High Court Cr.Misc. No.1467 of 2018(5) dt.15-03-2018 2/2 had received minor injuries.

The injury report has come on record but no definite finding has been arrived at by the doctor, who has examined the injured however, the injuries do not appear to be very serious in nature.

The petitioner is said to be having a clean antecedent except one old case in which he is already on bail. Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Kako P.S. Case No. 210 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
