The petitioner seeks bail in connection with Kesaria P.S. Case No. 131 of 2025 instituted for the offence under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023. 3.
The informant, a chowkidar, reported that on 11-04-2025 around 2:15 AM, two people were found murdered at Ajay Sah's house in Trilokwa Chowk. It is alleged that petitioner Aman Kumar killed his sister Priya Kumari and Vikash Kumar with an iron Musra after seeing them together. The motive is said to be their alleged love affair, and the petitioner was arrested at the scene.

It has been submitted on behalf of the petitioner
Patna High Court CR. MISC. No.50974 of 2025(2) dt.07-08-2025 2/3 that the petitioner is in custody since 12-04-2025. Petitioner bears no criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no independent witness to the occurrence. No incriminating material is recovered from the possession of the petitioner as alleged against him. There is no compliance of Section 103 of the BNSS, 2023.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Referring to impugned order, it is submitted that postmortem report corroborates with the allegation levelled against the petitioner. It is also submitted that the present one is the case of honour killing wherein petitioner has killed his sister and his lover when he found them in an objectionable condition, which is confessed by the petitioner in his confessional statement. 7.
Considering the aforesaid facts and circumstances of the case and there being direct allegation against the petitioner, this Court is not inclined to grant bail to the petitioner. Prayer is rejected.

The Trial Court is directed to expedite the trial as
