2. The petitioner is apprehending his arrest in Bahera P.S. Case No. 114 of 2025 registered under Sections 126(2), 115(2), 118(1), 109, 3(5) of BNS.
3. Allegedly, in course of returning from Ramjanki temple, in the way, the accused persons including the petitioner surrounded the informant and started assaulting him, as a result of which, he sustained injuries and became unconscious.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. As a matter of fact, on the occasion of Holi, the informant and his brothers started creating chaos in intoxicated state and when the petitioner and his uncle prohibited, they badly
Patna High Court CR. MISC. No.55446 of 2025(2) dt.27-08-2025 2/2 assaulted the father, the uncle and the cousin brother of the petitioner, for which, a case being Bahera P.S. Case No. 119 of 2025 has been lodged. The petitioner has also suffered injuries.
5. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Benipur in connection with Bahera P.S. Case No. 114 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Nawneet Kumar Pandey, J) A.K.V.//- U T
