JUSTICE AMARESH KUMAR LAL ORAL ORDER 11-08-2015 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case registered for the offence punishable under Sections 302, 201, 120B/34 of the Indian Penal Code. It is submitted that the four persons have been named in the FIR against whom the allegation has been made for committing the murder. The name of the petitioners has appeared in the confessional statement of the co-accused Hare Ram Choudhary, who has been granted bail vide Cr. Misc. No.3886/2015 (Annexure-2). There is no other material against the petitioners to implicate them in the alleged offence. The petitioners have been in custody since 20.09.2014, but uptill-now, no T.I. Parade has been held. However, after investigation, charge sheet has already been submitted. The case has been committed

Patna High Court Cr.Misc. No.28589 of 2015 (2) dt.11-08-2015 2/2 to the court of sessions. The charge has also been framed and there is no chance of tampering with the witnesses.

Considering the facts and circumstances of the case, let the above-named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Adhoc Additional Sessions Judge, VI, Patna in Sessions Trial No.233 of 2015 arising out of Budha Colony P.S. Case No.251 of 2014 with the following conditions : 1.

One of the bailors will be the close relative of the petitioners.

The petitioners will not indulge in similar or in any other offence.

3.

The petitioners will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
