Versus

The State of Bihar .... .... Opposite Party ====================================================== Appearance :

For the Petitioner/s : Mr. Abhishek Kumar For the Opposite Party/s : Mr. Dr.Ajit Kumar(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 2.

22-06-2016 Heard Sri Abhishek Kumar, learned counsel for the petitioner and Dr. Ajit Kumar, learned Addl. Public Prosecutor. This is the 3rd attempt for grant of bail on behalf of petitioner. The petitioner is an accused in a case registered for the offence under Sections 395 and 412 of the Indian Penal Code. It was a case of bank dacoity and thereafter, on merit, the prayer for bail was twice rejected.

Learned counsel for the petitioner submits that though trial has commenced, but it is proceeding slowly. Keeping in view the fact that on merit, the prayer for bail has been rejected as well as the fact that trial is going on, it is not desirable to review my earlier order.

Accordingly, the prayer for bail again stands rejected.

Patna High Court Cr.Misc. No.23677 of 2016 (2) dt.22-06-2016 2/2 Since trial has already commenced and the petitioner is in custody, it is desirable to observe that learned trial court may take steps for expeditious disposal of the trial. With above observation, the petition stands again rejected.
