The petitioner seeks bail in Parwalpur P.S. Case No. 178 of 2017 registered for the offence punishable under Sections 399, 402, 120B of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act.

Informant is the Officer-in-Charge of the Parwalpur P.S, who in his statement has stated that on 20.10.2017, while he was on patrolling duty along with other police personnel at about 12:30 pm he saw ten persons planning to commit some crime and when he reached near them six of them fled away and four were apprehended by the police including the petitioner. From the petitioner one country made pistol and one live cartridge along with mobile phone were recovered from

It has been contended on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case and prior to lodging of this case he had one case instituted against him but subsequent to his implication he has been made accused in remaining case also. Petitioner is in custody since 20.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Hilsa, Nalanda in connection with Parwalpur P.S. Case No. 178 of 2017.
