JUSTICE ARUN KUMAR ORAL ORDER 23-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Tankuppa PS Case No. 13 of 2017 registered under Sections 304B and 201/34 of the IPC.

The allegation in brief is that the petitioner and others in connection with demand of dowry killed his wife by setting her body on fire.

Learned Counsel for the petitioner submits that the petitioner's wife was suffering from depression as she wanted to get employment on compassionate ground to the post of the petitioner's father but she was not eligible; it is a case of suicide, the petitioner is constable in BSF, has two children out of the marriage and recently had deposited ten lakh rupees in the name of his son and daughter and is in custody since 19.8.2017.

Learned Counsel for the informant opposed the prayer for bail.

Having considered the said facts and circumstances, the petitioner, namely, Rahul Kumar Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two

Patna High Court Cr.Misc. No.1483 of 2018 (4) dt.23-02-2018 sureties of the like amount each to the satisfaction of ACJM lst, Gaya in connection with Tankuppa PS Case No. 13 of 2017. The petitioner is directed to appear before the trial court on each date and in case of his absence on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
