Petitioner seeks bail in Pakri Barawan P.S. Case No.133 of 2019 instituted for the offence under Section(s) 342, 365 Indian Penal Code.
Counsel for the petitioner submits that as per written report wife of the informant aged about 45 years disappeared from the house on 04.09.2018. It is further alleged that on 24.04.2019 he got telephone call from his wife, who disclosed that she is with Sanjay Yadav (petitioner). Thereafter, First Information Report has been lodged on 01.05.2019. It is alleged that victim has been recovered from the house of Awadhesh Yadav. She has given statement under Section 164 Cr.P.C. (Annexure-3) from which it appears that she was recovered
Patna High Court CR. MISC. No.45275 of 2019(2) dt.25-07-2019 2/2 from the house of Awadhesh Yadav. It further appears from the statement that she was with AwadheshYadav.
Petitioner is in custody since 07.05.2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Nawada, in connection with Pakri Barawan P.S. Case No.133 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
