Petitioner, already in custody, seeks bail in connection with Dariyapur P.S. Case No.182 of 2017, registered under Section 414 of the Indian Penal Code as well as under Sections 25(1-b) a, 26, 35 of the Arms Act.

Allegation in brief is that from the informant, the petrol pump owner, ransom demand was repeatedly being made from a mobile. He informed the police regarding this incident and police led a trap and when the petitioner along with other coaccused came on the motorcycle to collect the ransom money, the petitioner along with one other person were apprehended with a motorcycle and from possession of the petitioner one country made loaded pistol and a mobile were recovered.

Patna High Court Cr.Misc. No.2327 of 2018 (2) dt.17-01-2018 2 /2 Learned counsel for the petitioner submits that the petitioner is in custody since 15.07.2017 and he has no criminal antecedent.

Having considered the nature of the offence as the petitioner had gone in connection with collecting extortion money with loaded country made pistol and was also found in possession of a stolen motorcycle too, the prayer of bail of the petitioner is rejected in connection with Dariyapur P.S. Case No.182 of 2017, pending in the court of learned A.C.J.M.-IV, Saran at Chapra. The trial court is directed to expedite the trial and preferably conclude the same within a period of nine months.
