The petitioner apprehends his arrest in connection with Complaint Case No. 797C of 2016, registered for the offences punishable under Sections 420, 406 and 504 of the Indian Penal Code.

The complainant alleged that the petitioner took Rs. 50,000/- from the complainant on the eve of marriage of his daughter, but the petitioner did not return the money. A Panchayati was also held in which the petitioner has denied the allegation.

Learned counsel for the petitioner submits that the present complaint petition was filed on 14.09.2016 prior to this Khagaria P.S. Case No. 522 of 2016, filed by the daughter of the petitioner, namely,Rena Kumari, against

Patna High Court Cr.Misc. No.56967 of 2017 (2) dt.18-12-2017 2/2 the son of the complainant under Sections 366 and 376 of the Indian Penal Code.

Considering the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Khagaria, in connection with Complaint Case No. 797C of 2016, subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
