Petitioner is languishing in judicial custody since 14.10.2017 in connection with Pipra P.S. Case No. 260/2017 for offences punishable under Sections 302, 120-B/34 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case, as lodged by the informant, is that she received information that her husband has been killed by some guards of Reliance Company. When she reached the place of occurrence, the petitioner informed that three accused persons had shot her husband while he was going along with the informant's husband in his motorcycle. Accordingly, the petitioner was also made accused along with the three co-accused.

No.14993 of 2018 (2) dt.16-03-2018 2/3 It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated in the aforesaid case, rather he was the person who was going along with the informant's husband, had informed that the other three accused persons had fired on the informant's husband. He submits that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Pipra P.S. Case No. 260/2017, subject to the following conditions :
(i) One of the bailors would be a close relative of the petitioner having sufficient immovable property, who will file an affidavit stating his relationship with the petitioner.
(ii) Petitioner will appear before the learned court below during trial as and when required and failure to appear
Patna High Court Cr.Misc. No.14993 of 2018 (2) dt.16-03-2018 3/3 on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
