The petitioner seeks bail in Sultanganj P.S. Case No.86 of 2017 registered under Sections 341/342/354-D/504/506 of the Indian Penal Code and under Section 3/12 of POCSO Act and Sections 67 and 68 of the I.T. Act.
As per the prosecution case, the petitioner was having visiting terms at the house of the informant and developed lop sided love with the informant but as the informant is the minor her parents did not perform her marriage with the petitioner. Upon which the petitioner telephonically and by giving message on whatsapp extended threatening of dire consequence to the parents of the informant and also teases the informant on her way to school.
Patna High Court Cr.Misc. No.3426 of 2018 (02) dt.17-01-2018 2/ 2 It is submitted by learned counsel for the petitioner that admittedly the petitioner was having visiting terms to the informant. In course of his visit both the informant and the petitioner fell in love and there was chatting between them. Earlier the family of the informant met the petitioner's family and gave proposal of marriage with the informant and engagement was also made but as later on the family of the petitioner learnt that the informant is minor so they refused to marry the petitioner with the informant due to which the informant has filed this false and frivolous case against the petitioner after 11⁄2 months. The petitioner has been languishing in custody since 20.09.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1stAdditional Sessions Judge, Patna in connection with Sultanganj P.S. Case No.86 of 2017, subject to the condition that the petitioner will not extend any sort of threatening either to the informant or her family members and also not tease the informant anywhere in future.
