JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Raghunathpur P.S. Case No. 191 of 2017 registered under Sections 272, 273, 308 of the IPC and Section 41 of the Bihar Prohibition and Excise Act.

The accusation is that in course of checking of the vehicle one Hundai Car was stopped by the informant along with other police officials and 305 bottles each containing 180 ml. Indian made foreign liquor was recovered. One person, who was sitting in the car, was apprehended and he disclosed his name as Suresh Yadav and also disclosed that petitioner succeeded in fleeing away.

No.7670 of 2018 (2) dt.08-02-2018 2/2 Learned counsel for the petitioner submits petitioner was not apprehended from the spot and only on mere suspicion, he has been falsely implicated in this case. It is further submitted that petitioner has no criminal antecedent and is in custody since 21.11.2017.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Raghunathpur P.S. Case No. 191 of 2017. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) sushma/- U T
