Petitioner seeks regular bail in a case registered for the offence punishable under Section 498A, 307/34 of the Indian Penal Code and u/s 3⁄4 of Dowry Prohibition Act. As per the prosecution case, this petitioner along with other accused persons tortured the informant for non fulfillment of demand of dowry. It is further alleged that this petitioner assaulted the informant with Kulhari on her head. Learned counsel appearing for the petitioner submits that petitioner happens to be husband of the informant and both the parties have compromised the case and a compromise petition has already been filed before the court below
Patna High Court CR. MISC. No.58701 of 2021(3) dt.21-02-2022 2/2 (Annexure-2 of the supplementary affidavit). Petitioner claims clean antecedent and is in custody since 05.04.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, West, Muzaffarpur in connection with Karja PS case No. 263/2020.
