In this case, the petitioner is seeking bail in connection with Nathnagar (Lalmatiya) P.S. Case No. 240 of 2015 registered for offences under sections 461/379 of the Indian Penal Code.

Allegation has been made that from the temple a precious idle was stolen. Some persons were arrested. On the confessional statement, the name of the petitioner has surfaced. From the possession of the petitioner, one Gandi was recovered from his possession which is not alleged to have been stolen from the temple Looking to the facts and circumstances of the case,

Patna High Court Cr.Misc. No.21319 of 2016 (2) dt.19-05-2016 2/2 let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar (Lalmatiya) P.S. Case No. 240 of 2015, subject to the condition that (i) the court below will verify about the criminal antecedent of the petitioner (ii) one of the bailors shall be a close relative of the petitioner (iii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iv) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
