The petitioner seeks bail in connection with Nathnagar (Lalmatia) P.S. Case No. 320 of 2017registered for the offence punishable under Sections 366A, 379, 120B/34 of the Indian Penal Code.
Informant is the father of the victim girl, who in his written complaint has stated that on 05.07.2017 at about 08:10 am, the minor daughter left for her elementary school, but thereafter did not return. It has been further alleged that he came to know that Dharmraj Yadav who was his driver with his relatives had kidnapped the minor daughter of the informant. The girl has been recovered and the court had assessed her age to be 17 years whereas she has stated her age to be 19 years and
Patna High Court Cr.Misc. No.5389 of 2018(3) dt.27-02-2018 2/2 she has stated that she was in love with the petitioner and was often assaulted by her parents for this, and had gone with the petitioner with her own volition and sweet will. The petitioner has got no criminal antecedent and is in custody since 08.08.2017 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar (Lalmatia) P.S.
