JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-11-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioner seeks bail in a case registered for offence under Sections 103(1) and 3(5) of the BNS with added Section 61(2) of BNS and Section 27 of Arms Act.
3. The prosecution case, in brief, is that on 16.04.2025 at about 08:00 A.M. while the informant was present at his house, his son Majnu Gaddi went outside along with petitioner and other accused persons. In the evening, informant came to know that all the FIR named accused persons including this petitioner committed murder of his son and dead body of his son was found lying on the road.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.46694 of 2025(5) dt.24-11-2025 2/2 informant is not an eye witness to the alleged occurrence and has raised only suspicion against petitioner and others, because the son of the informant went along with them and thereafter, his dead-body was found. Similarly situated co-accused Shamshad Gaddi has been granted bail by this Court, vide order dated 53479 of 2025. Petitioner is in custody since 18.04.2025.
5. Learned counsel for the informant vehemently opposes the prayer for bail.
6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sasaram, Rohtas in connection with Sasaram (M) P.S. Case No. 127 of 2025.
