JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since 24.11.2015 in a case registered under Sections 307, 498(A), 34 and 304(B) of the Indian Penal Code.
The prosecution is based on the fardbeyan of the victim, the wife of the petitioner who has stated that on 01.11.2015 at 10:30 am, the petitioner fought with her for domestic disputes. Thereafter the petitioner assaulted and poured kerosene oil on her. Learned counsel for the petitioner submits that the informant was taken to P.M.C.H. and subsequently she succumbed to the burn injuries. It is further submitted that, in fact, petitioner has received burn injuries in course of saving his wife and the victim was provided medical assistance by the petitioner.
Patna High Court Cr.Misc. No.21352 of 2016 (2) dt.25-05-2016 2/2 Considering the nature of accusation levelled by the victim herself, this Court is not inclined to grant bail to the petitioner above named in Gandhi Maidan P.S. Case No. 458 of 2015, pending in the court of the learned Chief Judicial Magistrate, Patna.
