2. The petitioner is in judicial custody in connection with Mahua P.S. Case No. 129 of 2024/S.Tr. No. 720 of 2024 for the offence punishable under Sections 395 of the Indian Penal Code lodged on 16.03.2024 by the informant, Karuna Devi.
3. As per the prosecution story, the informant alleged that on the point of pistol, the accused persons took over the key of the Almirah and looted the ornaments alongwith the case. This led to the FIR.
4. Earlier, the bail application of the petitioner was rejected in Cr. Misc. No. 88094 of 2024 on 03.03.2025 taking into account that he has ten criminal cases under his belt.
5. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.47941 of 2025(4) dt.14-11-2025 2/3 charges have been framed and trial is on and if given a chance, he shall be diligently appearing in trial. He further submits that another Pankaj Kumar who was also an accused has since been granted bail in Cr. Misc. No. 37658 of 2025.
6. Learned APP opposes the prayer submitting that he has criminal antecedent.
7. Taking into account the aforesaid facts as also that the petitioner is in custody since 25.04.2024 and an undertaking has been given that he shall be diligently appearing in trial, trial is on, in that background, this Court is inclined to extend him the privilege of bail with conditions.
8. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-XII, Vaishali at Hajipur in connection with Mahua P.S. Case No. 129 of 2024/S.Tr. No. 720 of 2024 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive

(iii) the petitioner shall appear before the concerned police station every month till the conclusion of the trial to mark his attendance and at the end of the period, the certificate be submitted to the Court;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Vijay Singh/- U T
