The petitioner seeks bail in a case registered for the offences punishable under section 399, 402 and 414 of the Indian Penal Code and section 25(1-b)a 26 and 35 of the Arms Act.

The petitioner and others were apprehended while they were allegedly preparing for committing dacoity. From possession of the petitioner one country made pistol with live cartridges were recovered. Three mobiles were also recovered from possession of the petitioner.

It is submitted that other co-accused persons have already been enlarged on bail. The petitioner is in jail since

Patna High Court Cr.Misc. No.30272 of 2015 (2) dt.12-08-2015 22.11.2014 i.e. he has already remained in custody for about nine months.

Considering the facts aforesaid, let the petitioner above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sherghati, Gaya in connection with Sherghati P.S. Case No. 325 of 2014.
