JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-01-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Vidyapati Nagar P.S. Case No. 12 of 2017 registered under Sections 341, 323, 324, 379 and 504 read with 34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that there is a case and counter case and after
Patna High Court Cr.Misc. No.710 of 2018 (2) dt.11-01-2018 institution of the case, at the intervention of common friends, well-wishers, the parties have compromised the case and a compromise petition has already been filed in the court of A.C.J.M., Dalsingsarai.
Regard being had to the submissions made above, as the non-bailable offences are under Sections 324 and 379 of the Indian Penal Code only, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Dalsingsarai, Samastipur in connection with Vidyapati Nagar P.S. Case No. 12 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
