The petitioner is languishing in custody for the offences punishable under Sections 8/20B(II)(C)/25/39 of the N.D.P. S. Act.

Submission is that recovery of Ganja was from a truck. The petitioner was not there. The driver disclosed that he had to contact the petitioner on mobile call so that the narcotic could be handed over.

Submission is that no talk was there between the petitioner or the driver at any point of time. Only for criminal antecedent the petitioner is being implicated in different cases one after another. The petitioner is in custody since 02.05.2019.

No.47143 of 2019(2) dt.02-08-2019 2/2 Considering the aforesaid fact, let the petitioner, above named, be released on bail after completion of investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Musrigharari P.S. Case No.121 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
