The petitioner is languishing in jail custody since 12.04.2015 in a case registered for the offences punishable under Sections 395, 328 of the Indian Penal Code and subsequently 412 of the Indian Penal Code has been added.
The prosecution case is that while the informant was driving a loaded truck with Horlicks on the G.T. Road Gaya another truck overtook him and forcibly stopped his truck and on the point of pistol he pulled the informant out of the truck and after making him unconscious looted his cash and mobiles and fled away with his truck.
Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.29219 of 2015 (2) dt.05-08-2015 2/2 there are omnibus and general allegation leveled against the petitioner and the petitioner has not been named in the F.I.R. Learned counsel for the petitioner has further submits that the petitioner has not been put on Test Identification Parade and on the basis of confessional statement of co-accused, his name has come into the picture.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghati in connection with Amas P.S. Case No. 175/2014. (Nilu Agrawal, J) Sudha/- U T
