Petitioner no.1, Om Prakash Yadav, being the husband of the deceased and petitioner no.2, Ramadhin Yadav, being the father of petitioner no.1 are languishing in jail since 12.2.2016 in a case registered for the offence punishable under sections 341, 323, 307, 498A, 285, 504 and 304B of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Prosecution case is that petitioner no.1 poured kerosene oil on the body of the deceased and petitioner no.2 set her on fire. The F.I.R. has been lodged on the Fardbeyan of the deceased. It is submitted by the learned counsel for the petitioners that when the deceased caught fire, no one was present in the house and it was the petitioners who have taken her to the hospital.

Patna High Court Cr.Misc. No.22721 of 2016 (3) dt.20-06-2016 Considering the nature of accusation leveled against the petitioners, this Court is not inclined to grant bail to the petitioners in connection with Chainpur P.S.Case No. 234/2015 pending in the court of Addl. Chief Judicial Magistrate, Kaimur at Bhabhua. This application is, accordingly, rejected.
