The petitioner seeks bail in connection with Sahajitpur P.S. Case No. 40 of 2022 dated 09.03.2022 instituted for the offences under Section 394 of the Indian Penal Code and Section 27 of the Arms Act. The F.I.R. is against unknown.

The name of the petitioner has transpired in the confession of a co-accused whereafter he too has made a confession.

The learned counsel for the petitioner has

Patna High Court CR. MISC. No.52066 of 2022(2) dt.23-12-2022 2/2 submitted that apart from the aforenoted materials, there is no other evidence to connect the petitioner with the offence.

It has further been submitted that nothing incriminating has been recovered from his possession. The petitioner is in custody since 08.05.2022. Regard being had to the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Sahajitpur P.S. Case No. 40 of 2022.
