The petitioners apprehend their arrest in Kajraili P.S. Case No.53 of 2017 registered under Sections 341, 323, 324, 525, 506, 307, 504, 379, 448/34 of the Indian Penal Code. The informant alleged that on account of grazing the paddy crops by the got of the petitioner, the occurrence took place and all the accused persons assaulted the informant. Md. Tabrej to have assaulted the informant with iron rod causing left hand of the informant was fractured. It is further submitted that there is a counter version and Md. Tabrej also got injury. It appears that the informant got as many as 4 injuries- 3
Patna High Court Cr.Misc. No.141 of 2018 (2) dt.15-01-2018 2/2 injuries are simple in nature but one injury on account of grievous injury which is attributable by Md. Tabrej, petitioner No.3. Considering the facts aforesaid, I am not inclined to enlarge the petitioner No.3, Md. Tabrej, on bail. Accordingly, the same is rejected. So far the case of petitioner No.1, Md. Bablu @ Md. Bablu Alam, petitioner No.2, Md. Shahnawaz @ Md. Shahnawaz Alam, and petitioner No.4, Md. Suddu, are concerned, they are to have assaulted the informant to simple injury is caused and there is a counter version, the petitioners No.
1, 2 and 4, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIV, Bhagalpur in connection with Kajraili P.S. Case No.53 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
