Petitioners seek bail in a case registered for the offences punishable under Sections 120B, 121A of the Indian Penal Code and Sections 16, 17, 18, 19, 20, 21 of the UAP Act. The petitioners are in custody since 12.10.2017 having no criminal antecedent. According to FIR, when the police was combing against nuxals activity, the police stopped the Bolero vehicle on which the petitioners were also there and bomb was found in the vehicle.

Submission is that the vehicle was of the brother of the petitioner no. 1 and the petitioners had no knowledge what was being kept in the vehicle. The investigation is already

Patna High Court Cr.Misc. No.1128 of 2018 (4) dt.14-03-2018 2/2 complete and the petitioners are ready to cooperate with the trial. Considering the nature of allegation and nature of material available on the record, I am not inclined to enlarge the petitioners on bail for the present in connection with Chakai Police Station Case No. 135 of 2017 pending in the court of leanred Chief Judicial Magistrate, Jamui.

Hence, prayer for bail is refused.

Let the learned trial court expedite and conclude the trial within a period of six months from the date of receipt/production of a copy of this order, failing which the petitioners would be at liberty to renew their prayer for bail before the court below itself.
